Defendant Charles Lieber moves "to compel the government to produce materials concerning the Department of Justice's 'China Initiative' and the 'Thousand Talents Program' and to inspect" minutes of the grand jury. A First Superceding Indictment charges the defendant with, inter alia, two counts of making false statements that he "was never asked to participate in" and "'has never been a participant in' China's Thousand Talents Program" in violation of 18 U.S.C. § 1001(a)(2). (Docket Entry # 35, ¶¶ 32, 34, 43, 45). The government submits that the materials the defendant seeks regarding the China Initiative and the Thousand Talents Program are not "material" to his defense under Fed. R. Crim. P. 16(a)(1)(E) ("Rule 16(a)(1)"). It is well established that the defendant "bears the burden of showing materiality." United States v. Goris, 876 F.3d 40, 44 (1st Cir. 2017) (citation omitted). "[A] showing of materiality requires 'some indication' that pretrial disclosure of the information sought 'would have enabled the defendant significantly to alter the quantum of proof in his favor.'" Id. at 45 (internal citations omitted). The defendant contends that "all Thousand Talents contracts" entered into by other individuals "and related NIH investigations" as well as "any correspondence, recordings, seals, signatures, certificates, confirmations, receipts or other materials" will shed light on what it means to "participate" in the Thousand Talents Program. (Docket Entry # 56). The defendant, however, "does 'little more than speculate'" about what discovery of this material will yield. Goris, 876 F.3d at 46; see id. at 45 (stating that if "discovery request is grounded in a speculative theory," decision to deny "request is not an abuse of discretion"). The same defect permeates the defendant's request for materials concerning the China Initiative. In addition and for reasons stated by the government (Docket Entry # 66), the requested information from other agencies beyond the agencies government identifies as formally participating in the defendant's investigation, i.e., "the FBI, HHS, OIG, DCIS, AFOSI, and IRS['] Criminal Investigation" (Docket Entry # 66, p. 15), is not within the government's possession, custody, or control within the meaning of Rule 16(a)(1). See United States v. O'Brien, Crim. Action No. 12-40026-FDS, 2013 WL 1057929, at *5 (D. Mass. Mar. 13, 2013) (collecting First Circuit cases); LR. 116.8. As to these particular agencies, the government represents that it "complied with its discovery obligations." (Docket Entry # 66, p. 15). Also for reasons stated by the government (Docket Entry # 66), the defendant fails to show a particularized need for grand jury minutes under Fed. R. Crim. P. 6(e)(3)(E), and an in camera review is not warranted. See generally United States v. George, 839 F. Supp. 2d 430, 437 (D. Mass. 2012) (noting that Supreme Court repeatedly recognizes importance of grand jury secrecy and court has discretion to pierce secrecy and authorize disclosure if defendant shows ground exists to dismiss Indictment). "[T]he defendant bears the burden of showing 'particularized need,'" United States v. Calderon, 829 F.3d 84, 94 (1st Cir. 2016) (internal citation omitted), and he fails in discharging this burden.
