Some coverage and later recaps treat the case as a China Initiative “espionage” scalp. The Initiative was a real DOJ program. This caption is not an 18 U.S.C. § 794 or economic-espionage count. The Federalist later wrote that the Biden administration canceled the Initiative after allegations of racism; that sentence is the Federalist’s commentary (January 29, 2025, H-1B column). APA Justice and defense arguments that the Initiative racially targeted scientists are debate frames. They are not the verdict form.
